Richard Allen Appeal Part 2: What Happened Before Those Confessions? Part 2 — because this is where the Richard Allen appeal starts raising some very uncomfortable questions. The state has argued Allen was isolated for his own protection. The defense says those extreme conditions contributed to a severe psychological decline — and that matters because some of the prosecution’s most powerful evidence came from statements Allen made while incarcerated. So the question becomes: What condition was Richard Allen actually in when those statements were made — and did the jury get enough context to evaluate them? Then there’s another detail I still cannot get past. Investigators recovered multiple old phones from Allen’s home. But reportedly not the phone believed to have been used around the time of the murders in 2017. That does not prove anything by itself. But in a case built heavily around timelines, digital evidence and identification? The missing device matters. And now appellate judges are being asked to decide whether decisions made before and during Allen’s trial denied him the opportunity to fully challenge the state’s case. Again: this series is not me telling you whether Richard Allen is innocent or guilty. It’s me asking whether a conviction this serious was reached through a process strong enough to survive scrutiny.
