This one stops people in their tracks so let me say it clearly first: yes, there are circumstances where your employer can deny a leave extension request. But those circumstances are much narrower than most people think. The key word is "request." When you go to HR and ask for more time, you are asking. And they can say no to a request. But when your care provider certifies that you are not medically cleared to return to work, that is not a request. That is a medical certification that triggers specific protections under California law. Your employer's options in that situation are very different from their options when you just ask for extra time. The women who successfully extend their leaves are not the ones who had nicer HR teams or more sympathetic managers. They're the ones who understood the difference between requesting leave and asserting a certified right. Your care provider is your most important ally in this process.
