Here is where things get tricky for potentially pursuing criminal accountability for Canton Ohio Police Officer Michael Brown killing a family dog on a call for service under Goddard’s Law. Disclaimer—I am not a lawyer! I just enjoy discussing legal things and providing my commentary which is informed by my understanding of the law and the knowledge I have as a criminal justicr major. If you want legal advice, go retain a lawyer, babes. But basically, trying to get a criminal conviction for Officer Brown under Goddard’s law would be highly unlikely for multiple reasons, but also extremely difficult and risky. To gain a conviction for this under Goddard’s law, they would have to first prove that there’s reasonable suspicion a crime has been committed and considering the police’s place of privilege in vis position, an indictment is extremely unlikely. They would have to prove 1. That the killing of the dog was “needless” according to the law. In other words, they would have to prove that without the killing or incapacitating of the dog, the offender would’ve suffered serious bodily injury or death. 2. They would have to prove that the officer shot the dog *knowing* that it was unnecessary. Now…my personal opinion on both is that it was needless and that the officer should’ve known that it was needless considering he had multiple non-lethal tools at his disposal to incapacitate the dog without killing it, but it’s not my opinion that interprets the law. @she_fly488 Thank you so much for breaking that down, i really didn’t even expect you to reply to me❤️❤️ I thought that’s what Goddards law was for but again like you said “police accountability and citizen accountability are NOT the same.” This situation just sucks and he killed one of their family members. It’s just sad that can’t do anything about it.
