The Trump administration has followed through on President Donald Trump’s announcement that CNN, MS NOW and Politico would be barred from the White House, turning what began Friday as a presidential announcement into a major confrontation over press access. On Saturday, journalists from the three organizations were denied entry to the White House complex. Reporters said their press credentials were deactivated or confiscated. CNN correspondent Betsy Klein and MS NOW correspondent Akayla Gardner reported live after being turned away. Politico reporter Cheyenne Haslett was also denied entry, with Politico saying her White House access pass was confiscated. The action came after Trump accused the three outlets of what he called “fake news” and criticized their coverage of his administration. He also suggested that other media organizations could potentially face similar action. Now, the story is moving beyond a dispute between a president and the media. It is becoming a constitutional fight. CNN, MS NOW and Politico have indicated they intend to defend what they describe as their First Amendment rights, and legal challenges could follow. The White House Correspondents’ Association and press-freedom advocates have also raised constitutional concerns about restricting journalists based on their coverage or viewpoints. There is also legal history hanging over the confrontation. In a 1977 federal appeals court case involving White House press credentials, the court held that credentialed journalists could not be denied access arbitrarily or without procedural protections. How that precedent applies to this latest action remains an open legal question. For now, CNN and MS NOW say they will continue covering the Trump administration, even without access to the White House grounds. And that leaves one enormous question hanging over Washington: Where does presidential control of White House access end — and constitutional press protections begin?
